Order & Terms of the Auction:
1. Real Estate will be offered first.
a. 10% down day and location of the auction; balance due at closing within 30 days. Personal check may be used for the escrow/ down. Buyer will sign the auction contract immediately following the land auction.
b. Title search will be paid for by the seller. Title insurance will be paid for by the buyer. All other closing costs will be split 50-50 between the seller and buyer. Buyers are welcomed and encouraged to have a qualified legal opinion of the Title Insurance Policy if they so desire. This must done prior to closing, & at the buyer’s expense.
c. This is a “cash auction”. The property sells, and the buyer buys, without any contingencies, such as loan approval, appraisal, inspection, sale of property, etc.
d. Legal descriptions from the Title Closing office will prevail (as to the boundaries, acreage, property lines) over any & all printed or verbal statements in advertising & promotional material. Buyers are agreeing to this fact before, during, & after bidding, and/or purchase.
e. Effort has been made to represent the property honestly. In no case, is there any effort to deceive or hide facts and information from buyers. None the less, buyers MUST satisfy themselves as to the boundaries & conditions in every respect concerning the property. You are buying “as is, where is” with no recourse.
f. All verbal statements made at the auction will take precedence over any and all printed material. Do not bid if you do not agree with the terms of this auction.
g. Taxes were $302 for 2013.
2. The appliances sell next (Refrigerator, stove, washer, dryer, deep freeze).
3. The car sells
4. The books/library (ALL the books sell as one lot)
5. All the remaining contents of the house sell.
Note to Buyers: You will purchase everything with the home except the above listed items that sell separately. You will have 1 week to empty the house. You must take out everything, including the trash. There must not be any paper, trash, or items left. You will make a $300.00 clean-out deposit to the auction company in addition to the sales price of the household lot. This deposit will be refunded after satisfactory removal of items. The buyer does not have to sweep or vacuum the floor, but everything upstairs & in the basement must be cleaned out.
6. The contents of the garage will be sold in one lot.
Note to Buyers: The buyer will make a $100.00 clean out deposit in addition to the cost of the lot. This deposit will be refunded after satisfactory clean out and removal of items. Again, the garage must have all items & trash removed & cleaned out completely.
